Roland Curtains Inc., “Seller” expressly warrants that, Seller will repair or replace any defect free of charge for a period of 90 days following delivery, the warranty provided in this Agreement and the obligations and liabilities of Seller under this Agreement are in lieu of, and Buyer waives, all other warranties, guarantees, conditions, or liabilities, expressed or implied, arising by law or otherwise, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTY OF MERCHANTABILITY AS WELL AS ANY WARRANTY FOR A PARTICULAR PURPOSE as described in Texas Business and Commerce Code Section 2.315, the buyer shall assume all risks and liability for results obtained by use of goods whether single or in combination with other materials or products, and further including without limitation consequential damages, whether or not occasioned by Seller's negligence, and such warranty shall not be extended, altered, or varied except by a written instrument executed by the parties.
